Judicial Summary

(1) Failure to draw relevant evidence to the Traffic Commissioner鈥檚 attention meant that the Commissioner鈥檚 decision involved an error of law. (2) The Traffic Commissioner is not a party to an appeal made to the Upper Tribunal against the Commissioner鈥檚 decision. This means that the Upper Tribunal has no power to make a costs order against the Commissioner.
